Definitions and Interpretation

“Account” means a Customer account which has been opened by Bush Accessible Transport Services in respect of a particular Customer and which is identified by way of a confidential Customer Account Number allocated to the Customer and under which Bush Accessible Transport Services extends credit terms to the Customer enabling such Customer to pay on a periodic basis, based on statements of account provided by Bush Accessible Transport Services (or as otherwise agreed).

“Account Booking” means a Booking that is: (a) made through an Account; and (b) fulfilled by Bush Accessible Transport Services (as opposed to a Fulfilment Partner).

“Booking” means a booking made by a Customer for Services, howsoever communicated to us, as evidenced by our records.

“Business Day” means a day (excluding Saturdays, Sundays and public holidays) which is also a day on which are open for the conduct of business.

“Card Payment” means payment in relation to a Booking by any means other than by cash or cheque or direct debit, including but not limited to credit card, debit card, Apple Pay and PayPal payments.

“Charges” means the charges: (i) communicated to the person making the Booking; or (ii) for certain Account Bookings, the price calculated in accordance with charge rates agreed between Bush Accessible Transport Services and the Customer (in each case as applicable).

“Collection Address” means the address stated by the Customer at the time of making the Booking as the address from which the Vehicle shall collect the Customer, any Passengers or the Goods.

“Customer” and “You” means any person(s), firm or company which books Services.

“Destination Address” means the address stated by the Customer at the time of making the Booking as the address to which the Vehicle shall deliver the Customer, any Passengers or the Goods.

“Driver” means any person who drives a Passenger Vehicle.

“Minors” mean children of less than 14 years of age.

“Non-Account Booking” means a Booking that is: (i) not made through an Account; and (ii) arranged by Bush Accessible Transport Services as agent for the Driver where the Customer elects to pay by cash, or Card Payment.

“Passenger(s)” means the Customer and such persons who the Customer shall authorise and/or permit to make use of the Passenger Services by travelling in a Passenger Vehicle. By agreeing to or using the Services, each Passenger agrees to be bound by these Terms.

“Passenger Services” means the transportation of Passengers (together with any applicable luggage) by a Passenger Vehicle.

“Passenger Vehicle” means any vehicle used for the carriage of Passengers.

“Restricted Street” means any location subject to any parking law or regulation prohibiting any Vehicle waiting during prescribed hours.

“Services” means: (i) Passenger Services; and (ii) any other services agreed in writing between us and the Customer from time to time.

“Terms” means these terms and conditions, as amended from time to time.

“Vehicle” means a Passenger Vehicle.

“Waiting Time Charge” means £30 per hour payable in one minute increments.

“We”, “we”, “Our”, “our”, “Us” and “us” means: (i) in relation to Account Bookings, Bush Accessible Transport Services; and (ii) in relation to Non-Account Bookings, the Driver performing the Services.

“Writing” and “Written” means any written communication including email and SMS.

Bookings and Services

1. The Customer who has commissioned the services of Bush Accessible Transport Services is responsible for the behaviour of all Passengers on board the Vehicle, whether they travel on the Vehicle or not. The Customer will be responsible for any damage caused to the Vehicle by the Passengers and agrees to pay for said damage upon receipt of invoice. Bush Accessible Transport Services will only discuss details of the Booking with the Customer. If the Customer is not travelling with the Vehicle a representative must be nominated and Bush Accessible Transport Services informed of the details prior to the journey.

2. A 25% deposit must be paid at the time of Booking and will be non-refundable.

3. Outstanding balance is to be received in full fourteen days prior to the commencement of Services, by methods of payment specified by Bush Accessible Transport Services.

4. Quotations for the services of Bush Accessible Transport Services is provided on the information provided by the Customer. Collection Address and Destination Address will only be made as agreed with the Customer at time of Booking. The route used will be decided by the Driver unless a specific route has been requested by the Customer and has been agreed at time of Booking and shown on Booking confirmation.

5. Whilst courtesy time will be allowed to a maximum of ten minutes the Vehicle will depart at times agreed by the Customer when booking. It is the responsibility of the Customer to account for all Passengers. Bush Accessible Transport Services will not accept responsibility for any Passengers who are left at any location for not complying with the instructions of the Customer.

6. The Customer accepts the working hours of the Driver are regulated by law and as such shall not delay or interrupt the journey causing the Driver to breach such legislation. Any costs incurred by Bush Accessible Transport Services due to breach of regulations caused by the Customer or Passengers will be the responsibility of the Customer, and as such, costs will be paid by the Customer.

7. The Customer at time of Booking must specify number of Passengers travelling. The Customer must not attempt to overload the Vehicle beyond this number.

8. Vehicles are subject to restrictions when carrying luggage and hand luggage only will be accepted for transportation by Passengers.  If the transportation of luggage in excess of hand luggage is required this must be specified by the Customer at time of Booking to enable Bush Accessible Transport Services to comply with all legislation.

9. The Customer must not assume the availability of the Vehicle between the outward journey and return journey unless agreed at time of Booking.

10. The consumption or carrying of hot food, hot drinks and alcoholic drinks are not permitted on any Vehicle operated by Bush Accessible Transport Services.

11. Notices, banners, bill posters or decorations are not to be displayed by Passengers on any Vehicle operated by Bush Accessible Transport Services without prior approval.

12. Bush Accessible Transport Services will not be responsible for delays caused by traffic congestion, breakdown or other circumstances beyond the control of Bush Accessible Transport Services.

13. In the event of circumstances beyond the control of Bush Accessible Transport Services (e.g. terrorist attacks, civil unrest, adverse weather & road conditions, Police road closures, etc) we reserve the right to cancel the Booking without liability to Bush Accessible Transport Services, and return all monies paid excluding the deposit.

14. Bush Accessible Transport Services reserves the right to provide a Vehicle with a larger seating capacity than requested without any increased Charges to the Customer unless the number of Passengers specified is increased.

15. Bush Accessible Transport Services reserves the right to transfer the Services requested to another operator and the Customer accepts to be bound by the Terms and Conditions of that operator.

16. If the Customer cancels within seventy-two hours of the Booking the Customer is obligated to pay in full the amount agreed for the Services to be provided. All payments and deposits made are non-refundable.

17. In the event of a complaint the Customer should take the matter up at the time with the Driver. If the Customer is not satisfied with the outcome a written complaint should be submitted to Bush Accessible Transport Services, in Writing within five Business Days.
